Raids on Agrifields DMCC boss and associates by Kolkata police.
In a major development in the high-profile Sunland Projects Pvt Ltd case in Kolkata, the Alipore Police Court issued and executed search warrants across multiple locations, including the residence of promoter Amit Gupta in Ballygunge and those of directors Vivek Agarwal, Dinesh Agarwal, Vishal Agarwal, Subhash Chandra Khandelwal, and Govind Prasad Malpani.
The 18-page order from the Alipore Police Court authorized authorities "to seize and take possession of any forged documents, forged stamps & seals, computer-devices" and directed them to ensure that "every part and portion of the aforesaid office of the accused persons is needed to be searched thoroughly".
Court records in the Alipore Court case highlight procedural irregularities in a share transfer constituting 33.33% of the company's total shares. The documents were not signed by the petitioner, were not registered before a Public Notary, and the gift deed was not uploaded to the Ministry of Corporate Affairs website. The matter has also been brought before the National Company Law Tribunal (NCLT).
On December 22, 2023, Kolkata Police lodged an FIR against Amit Gupta, promoter of Agrifields DMCC, alleging "fraudulent share transfer" of 1,510,000 shares, "forging and manipulating records," and "illegally striking off a loan of Rs 9,95,64,143 from Sunland Projects Pvt Ltd.
According to the Sydney Morning Herald, "The US documents name Getax director Amit Gupta as the 'target of a criminal investigation who is alleged to have conspired with others to bribe foreign public officials and to have engaged in money laundering and other offences","
Court submissions indicate that Sunland holds real estate across India with assets exceeding Rs 700 crore. This includes the prominent Sunland Residency project in Rajarhat, which spans 54,000 square feet.
Amit Gupta is currently under criminal investigation in both Australia and India. The complexity of his financial dealings has come into sharper focus following Kolkata Police raids and scrutiny by several government agencies, including the Income Tax Department, which issued multiple notices to Gupta and his immediate family between March 22, 2022, and July 7, 2022.
